Welcome to One Wild Ocean. By accessing our website or purchasing from our store, you agree to these Terms of Service. Please read them carefully before using the site or placing an order.

One Wild Ocean is operated by Katie Masters (ABN 54 957 764 507). Our store is hosted on Shopify Inc. These terms apply to all visitors, customers, and users of onewildocean.com.

 

1. General

By using this website, you confirm that you are at least 18 years of age, or that you have the consent of a legal guardian. We reserve the right to refuse service to anyone at any time for any reason.

We may update these Terms of Service at any time. Changes take effect upon posting to the website. Continued use of the site constitutes acceptance of the updated terms.

 

2. Products

Physical Products

One Wild Ocean sells ocean-inspired physical products including tapestries, blankets, and other print-on-demand items, produced and fulfilled through Tapstitch. Products are made to order.

Product colours may vary slightly from screen to screen due to monitor display settings. We aim to represent all products as accurately as possible.

Digital Downloads

We also sell digital art downloads. All digital products are delivered electronically. By purchasing a digital product, you agree that:

•        Digital downloads are non-refundable once accessed or downloaded.

•        Files are for personal, non-commercial use only, unless otherwise stated.

•        You may not resell, redistribute, or share digital files with others.

•        You may not use digital files to train AI models or for any automated reproduction purposes.

 

3. Orders & Payment

All prices are listed in Australian Dollars (AUD) unless otherwise stated. We accept payment via the methods available at checkout, processed securely through Shopify Payments.

We reserve the right to cancel or refuse any order at our discretion, including in cases of suspected fraud, pricing errors, or product unavailability. If your order is cancelled, you will be refunded in full.

You will receive an order confirmation email after purchase. Please check your spam folder if you do not receive this within a few hours of ordering.

 

4. Shipping

Physical products are printed and shipped by Tapstitch. Production and delivery times are estimates only and may vary. One Wild Ocean is not responsible for delays caused by third-party carriers, customs, or circumstances outside our control.

Shipping costs and estimated delivery times are displayed at checkout. International orders may be subject to customs duties or import taxes, which are the responsibility of the customer.

If your order is lost or damaged in transit, please contact us at ahoy@onewildocean.au within 30 days of the estimated delivery date and we will work with our fulfillment partner to resolve the issue.

 

5. Returns & Refunds

Because our physical products are made to order, we do not accept returns or exchanges unless an item arrives damaged or defective.

If your product arrives damaged, please contact us within 14 days of receipt with a photo of the damage and your order number. We will offer a replacement or refund at our discretion.

Digital downloads are non-refundable once the file has been accessed or downloaded. If you experience a technical issue with your download, please contact us and we will do our best to assist.

6. Intellectual Property

All artwork, photography, written content, brand assets, and designs on this website are the intellectual property of One Wild Ocean, unless otherwise credited. All rights are reserved.

You may not reproduce, copy, distribute, or use any content from this website for commercial purposes without prior written permission. Personal, non-commercial sharing (e.g. sharing a product link) is welcomed and encouraged.

7. Wild Waters Substack

One Wild Ocean is connected to Wild Waters, a journal on Substack. Wild Waters content is subject to Substack's own Terms of Service in addition to these terms. Free and paid subscription tiers are managed through Substack directly.

Content published in Wild Waters is the intellectual property of the author and may not be reproduced without permission.

 

8. Discount Codes & Promotions

Discount codes are single-use and non-transferable unless otherwise stated. Codes cannot be combined with other offers. We reserve the right to withdraw or modify promotions at any time.

The welcome discount offered via our newsletter sign-up is valid for one use per customer on your first order only.

 

9. Privacy

We collect and use your personal information in accordance with our Privacy Policy, available on our website. By using our site, you consent to our data practices as described therein.

We use your email address to send order confirmations, shipping updates, and (where you have opted in) marketing communications. You may unsubscribe from marketing emails at any time.

 

10. Limitation of Liability

One Wild Ocean is not liable for any indirect, incidental, or consequential damages arising from the use of our website or products. Our total liability shall not exceed the amount paid by you for the product or service in question.

Nothing in these terms limits any rights you may have under Australian Consumer Law (ACL). Our products come with guarantees that cannot be excluded under the ACL, including that goods will be of acceptable quality.

 

11. Third-Party Links

This website may contain links to third-party websites, including Tapstitch, Substack, and social media platforms. We are not responsible for the content or practices of any third-party site. Visiting linked sites is at your own risk.

 

12. Governing Law

These Terms of Service are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
